Below are policies for both electric and fiber services. 

Electric policies

SUMMARY:

Paulding Putnam Electric Cooperative, Inc. (“PPEC”) is committed to protecting the privacy of all users of www.ppec.coop. As part of that commitment, this website privacy policy informs users:​

  1. What personal information (otherwise known as “personally identifiable information”) is collected and under what circumstances;
  2. Whether the collection is voluntary or involuntary;
  3. How that personal information is used;
  4. Who that personal information will be shared with and under what circumstances; and
  5. The ability of the user to choose how that personal information is used, how it can be reviewed and how it can be corrected.

The term “User” refers to any individual who is accessing the www.ppec.coop website.

This policy solely applies to information collected, maintained and used by PPEC and does not apply to the collection and use practices of websites which users connect to through any website links available on www.ppec.coop, nor does it apply to any applications or advertising posted on www.ppec.coop that is provided by third parties, including, but not limited to, the Co-op Connections Program.


CHILDREN UNDER THE AGE OF 13

The website is not intended for children under 13 years of age. No one under age 13 may provide any personal information to the website. PPEC does not knowingly collect personal information from children under 13 and PPEC does not provide services to children. Users under 13 years of age shall not provide any information on this website or through any of its features, making any purchases through the website, using any of the interactive or public comment features of this website or providing any information about themselves to us, including user name, address, telephone number, email address, or any screen name or user name used. If PPEC learns it has received personal information from a child under 13 years of age without verification of parental consent, PPEC will delete that information. COLLECTION OF INFORMATION:

  1. Web server log information – This is basic information that PPEC collects, including IP address, type of browser or operating system, date, time, duration of access, pages visited and links visited on the website. This information is automatically collected and may be used to help PPEC improve and maintain the availability and usefulness of the website for Users. This information is used in the aggregate for this purpose and no attempt is made to identify any specific individual.
  2. Cookies – Cookies are another means by which PPEC collects similar basic information as described at 1) above on all User visits that does not identify any specific individual and that shows how individual Users utilize the website. Cookies are bits of information collected by the web server and transferred back to the User’s computer, phone, tablet or other device to enable PPEC systems to recognize such device. Users may be able to set their browsers to alert the User of the creation of a cookie and/or a means to deny acceptance of a cookie. The Help feature on most browsers will tell users how to prevent your browser from accepting new cookies, how to have the browser notify users when such user receives a new cookie, or how to disable cookies altogether.
  3. Requests for programs/services/information – To the extent a User requests programs, services, or information from, or respond to surveys conducted by, PPEC through this website, personally identifiable information such as name, telephone number, mailing address and email address may be collected. Providing this personal information is voluntary, but failure to provide the requested information may preclude delivery of the product, service or information requested.


HOW WE MAY USE INFORMATION

PPEC uses the personal information that it collects about Users, or that Users provide to PPEC, to conduct our business and to provide programs, services, and information. Personal information collected may be shared with appropriate PPEC vendors or professional service providers. Examples of how PPEC uses personal information includes, but is not limited to:

  1. To present this website and its contents;
  2. To respond and provide Users with programs, services, or information requested from PPEC and its suppliers;
  3. To offer programs, services, or information that Users may find helpful;
  4. To notify Users about changes to our website or any products or services PPEC offers;
  5. In connection with a sale or merger;
  6. In any other way PPEC may describe when information is provided; and
  7. For any other lawful purpose with consent.
     

DISCLOSURE OF INFORMATION

We do not share information with third parties for their direct marketing purposes. Any information collected and retained by PPEC through this website will not be released to third parties except as indicated below:

  1. Any information needed by a vendor or professional service provider (e.g., NRECA, a law or accounting firm) to perform services for PPEC will be disclosed to such vendor or professional service provider. Such vendor or professional service provider will be required to observe the same privacy protections that apply to this website, and they will not be allowed to sell User information.
  2. Any necessary information will be disclosed to any appropriate internal or external authorities in order to 1) identify and pursue remedies against Users who attempt to damage, misuse, or otherwise interfere with the operations of this website, or 2) to otherwise protect PPEC’s legal interests.
  3. PPEC may aggregate information collected on the website, such as views or clicks, and share with third parties for PPEC’s business purposes.
  4. Any necessary information required to respond to appropriate requesting authorities, including but not limited to, properly issued search warrants, court orders, or subpoenas.  PPEC may also disclose User personal information to enforce the Terms of Use to this website.
  5. Any necessary information in connection with a sale or merger.
     

INFORMATION SECURITY

PPEC has implemented commercially reasonable technical, administrative, and physical security measures in order to protect personally identifiable information against loss, unauthorized access, destruction, misuse, modification, and improper disclosure.

As a critical part of these security measures, PPEC monitors any and all communications and data traversing the site. That monitoring may include actual content of those communications and data as necessary.

While no information is absolutely safe in an electronic environment, by implementing commercially reasonable security, PPEC has taken appropriate steps to secure information collected, retained and used.


REVIEW AND CORRECTION OF COLLECTED INFORMATION

CHANGES TO WEBSITE PRIVACY POLICY

From time to time, PPEC may revise this policy to reflect changes in the law, changes in our programs or services, changes in our practices regarding the collection and use of personal information, to reflect new features or technologies of www.ppec.coop or otherwise in the discretion of PPEC. Updated versions of the policy will appear on the website. PPEC encourages all Users to review this policy periodically so that they are up to date on the most current policies and practices. The last date this policy was revised is the effective date set forth above.

Eligibility: The Facebook/Instagram contests are open to current members of Paulding Putnam Electric Cooperatives inc.(PPEC) who are at least 18 years old at the time of entry, which includes employees’ immediate family (spouse, parents, siblings, and children) and household members. Employees of PPEC are not eligible.

Sponsor: The contest is sponsored by PPEC, located at 401 McDonald Pike, Paulding, OH 45879

Contest period: The period of the contest will be included with the contest post.

Entry: Duplicated entrances will be removed. Only one entrance per member will be counted.

Prizes: The prize description will be included with the post. PPEC will select potential winners in a random drawing from among all eligible entries received. The odds of being selected depend on the number of entries received. PPEC will attempt to notify the potential winner via Facebook/Instagram message.

Task: Information on how to participate will be included in the contest post.  

Winner selection: The potential winner will be randomly selected from all entries. Duplicated entries will be removed.

PAULDING PUTNAM ELECTRIC COOPERATIVE, INC.

“PAULDING PUTNAM”

Terms and Conditions of Information and Communications Services

 

Effective Date: 18th Day of September, 2025.

The following terms and conditions apply to all information and communications services provided PAULDING PUTNAM or its affiliates, contractors, vendors, or agents (hereinafter “PAULDING PUTNAM”, “Company”, “we” or “us”) including, but not limited to, fiber internet service, voice over internet protocol service, any other information or communications service provided by Company, and construction and installation services (collectively, the “Services”).  These Terms and Conditions of Information and Communications Services (“Terms and Conditions”) may be amended from time to time in the sole discretion of the Company, provided however that we will provide at least thirty (30) days’ notice to you (“Customer”) before implementing any amendments.  The application, these Terms and Conditions and Incorporated Policies, as amended from time to time by PAULDING PUTNAM and any terms and conditions set forth on a Service Order executed by Customer form the agreement between the Company and Customer ("Agreement").

By signing the application for Services provided by PAULDING PUTNAM, you (Customer) acknowledge that you are at least 18 years of age, have property ownership or possessory right, and are legally authorized to agree to these Terms and Conditions and Incorporated Policies. 

  1. SUBSCRIPTION, TERM, AND PAYMENT TERMS.  Unless otherwise specified on a Service Order, the Customer is subscribing to Services on a month-to-month basis.  
    1. With the exception of usage-based charges, you will be billed monthly in advance for the Services. Customer agrees to pay monthly charges in advance, including all applicable surcharges, taxes and fees, by the due date shown on the bill (the “Due Date”).
    2. Customer agrees to pay for all Services provided by PAULDING PUTNAM including but not limited to charges for installation, construction, set up, and Equipment, if needed.
    3. Operation Round Up:  Customer will be automatically enrolled in Operation Round Up. Operation Round Up will result in your bill being rounded up to the next highest dollar amount with the extra cents being deposited into a trust which funds charitable causes, unless Customer has elected to opt out of participation in Operation Round Up. Each new customer is automatically enrolled, but any customer who wishes not to participate may notify us by calling our office at (800) 686-2357.   1. DEPOSIT/LATE/OTHER CHARGES. Customer understands that PAULDING PUTNAM may require a deposit (“Deposit”) for Customers that are non-electric members of an amount up to one month’s service package amount.

    Customer understands that PAULDING PUTNAM may impose an administrative late fee (“Late Fee”) for each month’s charges not paid by the Due Date. The Late Fee is a reasonable estimate of costs to manage past due accounts. Examples of these costs include preparing additional bill statements, processing customer service records, mailing additional notices, tracking past due accounts, responding to inquiries regarding past due balances, making collection telephone calls, performing special procedures to process past due payments, generating work orders and performing necessary field work to collect past due accounts. PAULDING PUTNAM does not extend credit to the Customer and the Late Fee is not interest, a credit service charge or a finance charge.

If Service is disconnected, PAULDING PUTNAM may impose a reconnect charge (“Reconnect Charge”) and/or Deposit, in addition to collecting any outstanding balance, before service is restored. If Customer’s check is returned for insufficient funds, PAULDING PUTNAM may impose a service charge.

If Customer has not paid amounts due within 30 days of the due date, including but not limited to any charges for damaged or unreturned Equipment, a collection agency and/or attorney may be engaged to collect amounts due. Customer agrees to pay PAULDING PUTNAM for any amounts due, and all reasonable agency and attorney fees incurred, including, without limitation, court costs.

The fee schedule, as may be amended from time to time by PAULDING PUTNAM, is available on www.PPEC.coop.
 

  1. OWNERSHIP OF EQUIPMENT-RISK OF LOSS. In order to provide the Services, we will install equipment in and around your premises. This equipment may include, but is not limited to, a Network Interface Device ("NID"), routers, cabling, battery backup, and mesh units (collectively the "Equipment").   This Equipment and all other PAULDING PUTNAM property installed on the premises shall remain the sole and exclusive property of PAULDING PUTNAM. Customer agrees to pay any inside Equipment lease charges associated with the Service, if using PAULDING PUTNAM’s inside Equipment. You agree that you will not move any of the Equipment to another location outside your premises either temporarily or permanently. You are responsible for the care and maintenance of the Equipment located at your premises. You agree not to modify the Equipment in any way. If any of the Equipment is damaged, modified, lost, destroyed, tampered with, or stolen while in your possession, you will be responsible for the reasonable cost of repair or replacement of the affected Equipment.
    1. Acts of God: If Equipment is damaged due to an act of God and Customer is not terminating service, PAULDING PUTNAM will replace Equipment at no charge.
    2. TAMPERING/MISUSE/LOST/STOLEN. You shall not alter, misuse, repair, or in any manner tamper with the Equipment or outlets or remove from the Equipment any markings or labels. Equipment cannot be removed from Customer’s premises and used in another location. You are responsible for the safekeeping of all Equipment. If any Equipment is destroyed, damaged, lost or stolen while in your possession, Customer shall be liable for the cost of repair or replacement of the Equipment.
    3. SERVICE AND REPAIRS. PAULDING PUTNAM will make reasonable efforts to maintain our system and respond to service calls in a timely manner. PAULDING PUTNAM will repair damage to Equipment, or interruption of Service, due to reasonable wear and tear or technical malfunction. Notwithstanding the foregoing, Customer shall be solely responsible for physical damage to Equipment caused by Customer’s intentional misuse or negligence and in such case shall reimburse PAULDING PUTNAM for the cost of repair or replacement
       
  2. TERMINATION OF SERVICE. Upon termination of service for any reason, you agree to immediately return all Equipment in the operating condition as when received, reasonable wear and tear excepted, directly to PAULDING PUTNAM within 5 business days of the termination. When you cease being a consumer or move from your current location, you are responsible for returning the Equipment to us (with the exclusion of any wiring or Equipment located outside your premises).  If you paid a Deposit when you initiated service, we will apply any remaining portion of the Deposit to the costs we incur to repair or replace damaged or unreturned Equipment.  You will be responsible for any costs that exceed the Deposit. In the event that the Equipment is destroyed, damaged, lost or stolen, or not returned to PAULDING PUTNAM for any reason within 5 business days of termination, Customer shall be liable to PAULDING PUTNAM for the full replacement cost of any unreturned or damaged Equipment.

Customer understands and agrees that any credit balance on the account, including any Deposit may be used to offset the cost of any unreturned or damaged Equipment. You will be responsible for any costs that exceed the Deposit.

    1. TERMINATION OF SERVICE BY CUSTOMER. Unless otherwise specified on a Service Order, Customer may terminate Service by providing PAULDING PUTNAM at least 7 days advance notice. Customer may terminate Service in person at the office or by telephone. Account holders are liable for all Services rendered by us up to the time the account has been de-activated, and PAULDING PUTNAM has received all Equipment.
    2. TERMINATION OF SERVICE BY PAULDING PUTNAM. Once Customer’s bill is past due, PAULDING PUTNAM may disconnect Service. Upon termination for any reason, we may charge additional fees on any unpaid balance. Further, Customer understands and agrees that PAULDING PUTNAM may charge the credit card on file at termination of Service in the amount of any outstanding balance and/or for the cost for any unreturned or damaged Equipment, in accordance with applicable law.
      1. PAULDING PUTNAM takes the safety of its employees and customers very seriously. We reserve the right to immediately terminate Customer’s fiber internet and any fiber-related service should Customer make any threats, physical or otherwise, against PAULDING PUTNAM, its employees, affiliates, suppliers, agents, contractors, or anyone else representing PAULDING PUTNAM.
  1. THEFT OF SERVICE. The receipt of Services without our authorization is a crime. You understand that the law prohibits willful damage, alteration or destruction of Equipment. You can be subject to both civil and criminal penalties for such conduct. Customer shall not move Equipment to another location or use it at an address other than the Service address without prior authorization from PAULDING PUTNAM.
     
  2. SERVICES, RATES, AND TERMS AND CONDITIONS SUBJECT TO CHANGE. Unless otherwise specified on a Service Order, Customer acknowledges and agrees that the Services, rates, and charges set forth on any Service Order may be amended, modified, discontinued, or revoked by PAULDING PUTNAM at any time, provided however, that PAULDING PUTNAM will provide at least thirty (30) days’ prior notice to Customer before implementing any price change or amending revoking any service offering.  Any promotions offered by PAULDING PUTNAM may be strictly limited and subject to change with respect to length, market and circumstances offered. Such promotions may not be available to all consumers. 
    1. PAULDING PUTNAM will not switch the Consumer to a different telecommunications provider, submit a preferred carrier change order, or bill the Consumer for services added to the Consumer’s service order without the Consumer’s authorization and in compliance with applicable federal and state law. Notwithstanding any other provision of this Agreement to the contrary, Customer may file a complaint with the applicable state regulatory commission.
    1. Notwithstanding any other provision of this Agreement to the contrary, Customer shall have all customer telecommunications service rights available under applicable law including, but not limited to, notice of proposed rate changes, billing contents, billing adjustments to the known date of error or for a period of eighteen (18) months, whichever is shorter, prohibition on unauthorized switching of telecommunications providers and billing for telecommunications services added without the Consumer’s consent, and Consumer complaints to the applicable state regulatory commission.
  1. TRANSFER OF ACCOUNT/CHANGE OF RESIDENCE. The Service shall only be provided at the address where PAULDING PUTNAM performs installation. Customer may not transfer Customer’s rights or obligation to the Service to any successor tenant or occupant or to any other address without PAULDING PUTNAM’s prior consent. If previous party is deceased, Customer must provide a death certificate.
     
  2. ACCESS ON PREMISES. By entering into this Agreement, Customer hereby grants to PAULDING PUTNAM and its affiliates, contractors, subcontractors, a license to enter upon Customer’s premises to construct, install, maintain, relocate, inspect and/or replace all other Equipment necessary to provide Services. If Customer is not the “Owner” of the premises, Customer warrant that they have authority to grant such a license to PAULDING PUTNAM or that they have obtained the consent from the Owner of the premises for PAULDING PUTNAM to make the installation and maintenance contemplated by this Work Order. If Customer is not the Owner, Customer shall indemnify and hold PAULDING PUTNAM harmless from and against any claims of the Owner of the premises arising out of the performance of this Agreement. If Customer indicated on the Installation and Service Agreement that Customer is the Owner of the Property or the Designated Agent of the Owner, Customer agrees that:
    1. By signing this agreement for communications service, Customer represents that they are the Owner of the property at which broadband internet service is being provided or the designated agent of the Owner of the property, and Customer expressly consents to the expansion of the electric easement that PAULDING PUTNAM has on my property to include communications infrastructure.
    2. By signing this agreement for communications service or master agreement or a notarized affidavit, Customer acknowledges that they are not entitled to any additional compensation for the expansion of the electric easement to include communications infrastructure, other than the value of being provided access to any communications service that PAULDING PUTNAM may offer.

Customer understands that anyone other than the property Owner or the property Owner's designated agent may be: (A) subject to penalties for perjury; and (B) liable for any just compensation provided for by law; for representing to PAULDING PUTNAM that Customer is the Owner of the property and signing the agreement without the consent of the property Owner or the property Owner's designated agent.
 

  1. CORRESPONDENCE. Do not mail written correspondence with your bill statement. PLEASE SUBMIT ALL CORRESPONDENCE TO PAULDING PUTNAM’S LOCAL OFFICE. Customer is encouraged to call the office and speak directly with a representative at 800-686-2357.
     
  2. PRIOR ACCOUNTS. Customer warrants that no monies are owed to PAULDING PUTNAM from previous accounts with PAULDING PUTNAM. If PAULDING PUTNAM finds a prior account with Customer where money is owed to PAULDING PUTNAM, then PAULDING PUTNAM may apply any funds received to that prior account.
  1. CUSTOMER WARRANTIES. Customer represents and warrants that you are at least 18 years of age and are legally authorized to enter into this Agreement. Customer warrants that you are legally empowered to authorize PAULDING PUTNAM to enter the premises for the purposes set forth in this Agreement, including but not limited to:
    1. placing fiber-optic lines near or adjacent to the current locations of other utilities on the property, and if necessary, to install an above ground pedestal on the premises;
    2. attaching wiring and equipment to a structure; and
    3. installing, maintaining, repairing, or disconnecting Service.
  1. WARRANTY DISCLAIMER; LIMITATION ON DAMAGES. CONSUMER AGREES THAT ALL SERVICES ARE PROVIDED BY COMPANY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THAT SUCH SERVICES WILL BE ERROR FREE. COMPANY MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, OR WILL SECURE CONSUMER'S COMPUTER FROM THIRD PARTY UNAUTHORIZED ACCESS OR MONITORING. CONSUMER AGREES THAT ALL USE OF THE SERVICES IS AT CONSUMER'S SOLE RISK AND CONSUMER EXPRESSLY ACKNOWLEDGES AND ACCEPTS THE SERVICES KNOWING THAT SUCH SERVICES ARE SUBJECT TO INTERRUPTION FROM POWER OUTAGES AND EQUIPMENT FAILURES.

PAULDING PUTNAM’S TOTAL LIABILITY AND CUSTOMER’S EXCLUSIVE REMEDY WITH RESPECT TO THE SERVICES, THE INSTALLATION, REPAIR, REPLACEMENT, OR REMOVAL OF COMPANY'S EQUIPMENT, THE USE OR INABILITY TO USE THE SERVICES, OR THE USE OR INABILITY TO USE ANY THIRD PARTY SERVICES INCLUDING, BUT NOT LIMITED TO E911 SERVICE AND HOME SECURITY OR MEDICAL MONITORING SERVICE, SHALL BE LIMITED TO THE amount paid by customer for the Services during the preceding thirty (30) day period.

IN NO EVENT WILL PAULDING PUTNAM OR ITS AFFILIATES, CONTRACTORS, OR SUBCONTRACTORS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL (including lost profits), OR PUNITIVE DAMAGES UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, THE INSTALLATION, REPAIR, REPLACEMENT, OR REMOVAL OF COMPANY'S EQUIPMENT, THE USE OR INABILITY TO USE THE SERVICES, OR THE USE OR INABILITY TO USE ANY THIRD PARTY SERVICES INCLUDING, BUT NOT LIMITED TO E911 SERVICE AND HOME SECURITY OR MEDICAL MONITORING SERVICE, WHETHER OR NOT PAULDING PUTNAM HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES.

Customer assumes all responsibility and liability for the security of information on Customer’s personal devices and information Customer transmits or receives through the Services. PAULDING PUTNAM has no responsibility and disclaims any liability for the security of any information on Customer personal devices, or the security or accuracy of any information or data transmitted or received through the Services. PAULDING PUTNAM shall not be liable for unauthorized access by third persons to Customer personal devices, files, or data or any loss or destruction of files or data.

  1. CUSTOMER INDEMNIFICATION. CUSTOMER AGREES THAT HE/SHE IS RESPONSIBLE FOR AND SHALL DEFEND, INDEMNIFY, AND HOLD HARMLESS PAULDING PUTNAM AND ITS EMPLOYEES, AFFILIATES, SUPPLIERS, AGENTS AND CONTRACTORS AND SHALL REIMBURSE US FOR ANY DAMAGES, LOSSES OR EXPENSES (INCLUDING WITHOUT LIMITATION, REASONABLE ATTORNEY'S FEES AND COSTS) INCURRED BY US IN CONNECTION WITH ANY CLAIMS, SUITS, JUDGMENTS AND CAUSES OF ACTION ARISING OUT OF; (i) YOUR USE OF THE SERVICE OR EQUIPMENT; (ii) VIOLATION OR INFRINGEMENT OF CONTRACTUAL RIGHTS, PRIVACY, CONFIDENTIALITY, COPYRIGHT, PATENT, TRADEMARK, TRADE SECRET, OR OTHER INTELLECTUAL PROPERTY AND PROPRIETARY RIGHTS ARISING FROM YOUR USE OF THE SERVICE OR ANY UNAUTHORIZED APPARATUS OR SYSTEM; (iii) YOUR BREACH OF ANY PROVISION OF THIS AGREEMENT; and (iv) VIOLATION OF LOCAL, STATE, OR FEDERAL LAW ARISING FROM YOUR USE OF THE SERVICE OR THE EQUIPMENT.
     
  2. SERVICE INTERRUPTIONS. PAULDING PUTNAM assumes no liability for interruption of Service or alterations in programming due to circumstances beyond our control, including without limitation, acts of God, natural disaster, fire, civil disturbance, strike or weather. PAULDING PUTNAM assumes no liability for any substitution, discontinuation or modification of any SERVICES.
     
  3. VOICE  911/E 911 SERVICE  LIMITATIONS AND LIMITATION OF LIABILITY. Customer acknowledges that the Services are provided subject to, and Customer agrees to comply with PAULDING PUTNAM’s E911 Disclosure and Limitation of Liability Policy, as may be amended from time to time, which can be found at www.PPEC.coop. It may be requested by contacting PAULDING PUTNAM at 401 McDonald Pike, Paulding, Ohio 45879, or by calling 800-686-2357.
  1. INTERNET ACCESS SPEEDS. The internet access speeds quoted are the maximum rates by which downstream Internet access data may be transferred between PAULDING PUTNAM facilities and the network interface device at Customer’s home, office or apartment building. The maximum rate is not guaranteed and may vary. The quoted speeds should not be confused with the speed at which Customer’s modem receives and sends Internet access data through the public internet as such speeds are impacted by many factors beyond PAULDING PUTNAM’s control. Actual internet speeds vary due to many factors including the capacity or performance of the Customer’s computer or modem and its configuration, Customer’s wiring and any wireless configuration, your destination and traffic on the Internet, internal network or other factors at the internet site with which you are communicating, congestion on the network and the general speed of the public internet.  The actual speed may affect your on-line experience including ability to view streaming video and speed of downloads. Except as otherwise provided by law, PAULDING PUTNAM reserves the right to implement network management controls to optimize and ensure that adequate speed and data transfer is available to all internet service Customers.
  1. POLICY’S APPLICABLE TO CUSTOMER’S INTERNET USE. Customer acknowledges that the Services are provided subject to, and Customer agrees to comply with PAULDING PUTNAM’s Acceptable Use and Network Management Practices Policy, DMCA Copyright Infringement Policy[RH1] , Broadband and VOIP Privacy Policy, and Non-Recurring Fee Schedule (together the “Incorporated Policies”), as may be amended from time to time by PAULDING PUTNAM. The Incorporated Policies can be found at www.PPEC.coop and are also available upon request by contacting PAULDING PUTNAM at 401 McDonald Pike, Paulding, Ohio 45879, or by calling 800-686-2357.
  1. COOPERATION WITH LAW ENFORCEMENT. If, in our sole and reasonable judgment, we believe you are using any of our Services for an illegal purpose, you acknowledge and agree that we may provide information about your usage to proper legal authorities for investigation and prosecution. You also agree that we may forward information about you and your use of the Services in response to law enforcement requests, subpoenas, court orders or similar requests when we reasonably determine that the disclosure of such information is appropriate and warranted under the circumstances.
  1. JURISDICTION AND VENUE. Jurisdiction and venue for all disputes will be Paulding County, Ohio. Both parties expressly waive the right to request a trial by jury regarding any legal dispute arising from this Agreement.
  1. Electronic Signatures, Notices and Disclosures. Customer consents to the use of electronic signatures for all agreements with us and consents to receive any or all notices and disclosures we send online or through other electronic means.
  1. MISCELLANEOUS. The Agreement may not be assigned by Customer. Company may assign this Agreement without Customer consent. The invalidity or unenforceability of any provision of the Agreement shall not affect the other provisions, and the Agreement shall be construed in all respects as if such invalid or unenforceable provision had not been a part of the Agreement. The format, words and phrases used in this Agreement shall have the meaning generally understood in the information, internet, and communications industries. This Agreement shall be construed in accordance with its fair meaning and not against the drafting party. The Agreement, along with the terms and conditions set forth in any Service Order represents the entire understanding between the parties and supersedes all prior agreements and representations whether express or implied, oral or written. Customer acknowledges that Customer is not entering into this Agreement in reliance on any term, condition, representation or warranty not expressly stated in the Agreement.

  2. COMPLIANCE WITH AGREEMENT. PAULDING PUTNAM reserves the right to suspend performance or terminate Services for Customer’s breach of any of these Terms and Conditions or Incorporated Policies related to the Services.

Acceptable Use and Network Management Practices Policy

Why is Paulding Putnam providing this Acceptable Use and Network Management Practices Policy to me?
This Acceptable Use and Network Management Practices Policy (the “Policy”) outlines acceptable use of Paulding Putnam Electric Cooperative, Inc. (“Paulding Putnam”) fiber internet service (the “Service”). This Policy is in addition to any restrictions or conditions contained in any customer or subscriber agreement executed by you and Paulding Putnam with respect to the Service (each a “Subscriber Agreement”).

All Paulding Putnam customers receiving the Service (the “customer,” “user,” “you” or “your”) and all others who use the Service must comply with this Policy. Your failure, or others’ failure, to comply with this Policy could result in the suspension or termination of your or their Service accounts. Therefore, you should take steps to ensure that others you permit to use your Service are aware of this Policy and agree to abide by it. If you are unwilling to comply with this Policy, you must immediately stop all use of the Service and notify Paulding Putnam so that it can close your account.

How will I know when Paulding Putnam changes this Policy, and how do I report violations of it?Paulding Putnam may revise this Policy from time to time by posting a new version on its website at www.ppec.coop (the “Website”). Paulding Putnam will use reasonable efforts to make customers aware of any changes to this Policy, which may include sending email announcements or posting information on the Website. Revised versions of this Policy are effective immediately upon posting. Accordingly, customers of the Service should read any Paulding Putnam announcements they receive and regularly visit the Website and review this Policy to ensure that their activities conform to the most recent version. You can send questions regarding, and reports violations of, this Policy to the attention of the Chief Operating Officer at 401 McDonald Pike, Paulding, OH  45879.

  1. Prohibited Uses and Activities

What uses and activities does Paulding Putnam prohibit?
In general, the Policy prohibits uses and activities involving the Service that are illegal, infringe the rights of others or interfere with or diminish the use and enjoyment of the Service by others. For example, these prohibited uses and activities include, but are not limited to, using the Service or customer-provided or Paulding Putnam-provided equipment, either individually or in combination with one another, to:

Conduct and information restrictions

    • undertake or accomplish any unlawful purpose. This includes, but is not limited to, posting, storing, transmitting or disseminating information, data or material that is libelous, obscene, unlawful, threatening or defamatory or that infringes the intellectual property rights of any person or entity or that in any way constitutes or encourages conduct that would constitute a criminal offense or otherwise violate any local, state, federal or non-U.S. law, order or regulation;
    • post, store, send, transmit or disseminate any information or material that a reasonable person could deem to be unlawful;
    • upload, post, publish, transmit, reproduce, create derivative works of or distribute in any way information, software or other material obtained through the Service or otherwise that is protected by copyright or other proprietary right without obtaining any required permission of the owner;
    • transmit unsolicited bulk or commercial messages commonly known as “spam;”
    • send very large numbers of copies of the same or substantially similar messages, empty messages or messages that contain no substantive content or send very large messages or files that disrupt a server, account, blog, newsgroup, chat or similar service;
    • initiate, perpetuate or in any way participate in any pyramid or other illegal scheme;
    • participate in the collection of very large numbers of email addresses, screen names or other identifiers of others (without their prior consent), a practice sometimes known as spidering or harvesting, or participate in the use of software (including “spyware”) designed to facilitate this activity;
    • collect responses from unsolicited bulk messages;
    • falsify, alter or remove message headers;
    • falsify references to Paulding Putnam or its network, by name or other identifier, in messages;
    • impersonate any person or entity, engage in sender address falsification, forge anyone else’s digital or manual signature or perform any other similar fraudulent activity (for example, “phishing”);
    • violate the rules, regulations, terms of service or policies applicable to any network, server, computer database, service, application, system or website that you access or use;

 

Technical restrictions

    • access any other person’s computer or computer system, network, software or data without his or her knowledge and consent, breach the security of another user or system, or attempt to circumvent the user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other hosts, networks or accounts without express permission to do so;
    • use or distribute tools or devices designed or used for compromising security or whose use is otherwise unauthorized, such as password guessing programs, decoders, password gatherers, keystroke loggers, analyzers, cracking tools, packet sniffers, encryption circumvention devices or Trojan Horse programs. Unauthorized port scanning is strictly prohibited;
    • copy, distribute or sublicense any proprietary software provided in connection with the Service by Paulding Putnam or any third party, except that you may make one copy of each software program for back-up purposes only;
    • distribute programs that make unauthorized changes to software (cracks);
    • use or run dedicated, standalone equipment or servers from the customer’s premises that provide network content or any other services to anyone outside of your premises local area network (“Premises LAN”), also commonly referred to as public services or servers. Examples of prohibited equipment and servers include, but are not limited to, email, web hosting, file sharing and proxy services and servers;
      • use or run programs from your premises that provide network content or any other services to anyone outside of your Premises LAN, except for personal and non-commercial residential use;
      • service, alter, modify or tamper with the Paulding Putnam-provided equipment or Service or permit any other unauthorized person to do the same;

 

Network and usage restrictions

    • use the Service for any purpose other than personal and non-commercial residential use (except for your individual use for telecommuting);
    • use the Service for operation as an internet service provider or for any business, other legal entity or organization purpose (whether or not for profit);
    • restrict, inhibit or otherwise interfere, regardless of intent, purpose or knowledge, with the ability of any other person to use or enjoy the Service (except for tools for safety and security functions such as parental controls, for example), including, without limitation, posting or transmitting any information or software that contains a worm, virus or other harmful feature;
    • impede others’ ability to use, send or retrieve information;
    • restrict, inhibit, interfere with or otherwise disrupt or cause a performance degradation, regardless of intent, purpose or knowledge, to the Service or any Paulding Putnam (or supplier thereof) host, server, backbone network, node or service or otherwise cause a performance degradation to any Paulding Putnam (or supplier thereof) facilities used to deliver the Service;
    • resell the Service or otherwise make available to anyone outside of your premises the ability to use the Service (for example, through WiFi or other methods of networking), in whole or in part, directly or indirectly;
    • connect the Paulding Putnam-provided equipment to any computer outside of your premises;
    • interfere with computer networking or telecommunications service to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abusing operator privileges, and attempts to “crash” a host; or
    • access and use the Service with anything other than a dynamic Internet Protocol (“IP”) address that adheres to the dynamic host configuration protocol (“DHCP”). You may not configure the Service or any related equipment to access or use a static IP address or use any protocol other than DHCP unless you are subject to a Service plan that expressly permits you to do so.
  1. Customer Conduct and Features of the Service

What obligations do I have under this Policy?
You are responsible for your own compliance with this Policy. You are also responsible for any use or misuse of the Service that violates this Policy by anyone else you permit to access the Service (such as a friend, family member or guest). Paulding Putnam recommends against enabling file or printer sharing unless you do so in strict compliance with all security recommendations and features provided by Paulding Putnam and the manufacturer of the applicable file or printer sharing devices. Any files or devices you choose to make available for shared access on a home LAN, for example, should be protected with a strong password or as otherwise appropriate.

In all cases, you are solely responsible for the security of any device you connect to the Service, including any data stored or shared on that device. It is also your responsibility to secure the customer-provided equipment and any other premises equipment or programs not provided by Paulding Putnam that connect to the Service from external threats such as viruses, spam, bot nets and other methods of intrusion.

How does Paulding Putnam address inappropriate content and transmissions?
Paulding Putnam reserves the right to refuse to transmit or post, and to remove or block, any information or materials, in whole or in part, that it, in its sole discretion, deems to be in violation of this Policy or otherwise harmful to Paulding Putnam’s network or customers using the Service, regardless of whether this material or its dissemination is unlawful. Neither Paulding Putnam nor any of its affiliates, suppliers or agents have any obligation to monitor transmissions or postings (including, but not limited to, email, file transfer, blog, newsgroup and instant message transmissions) made on the Service. However, Paulding Putnam and its affiliates, suppliers and agents have the right to monitor these transmissions and postings from time to time for violations of this Policy and to disclose, block or remove them in accordance with this Policy, a Subscriber Agreement and applicable law.

 

What requirements apply to email?
The Service may not be used to communicate or distribute email or other forms of communications in violation of this Policy. As described below, Paulding Putnam uses reasonable network management tools and techniques to protect customers from receiving and sending spam (often without their knowledge over an infected computer).

Paulding Putnam is not responsible for deleting or forwarding any email sent to the wrong email address by you or by someone else trying to send email to you. Paulding Putnam is also not responsible for forwarding email sent to any account that has been suspended or terminated. This email will be returned to the sender, ignored, deleted or stored temporarily at Paulding Putnam’s sole discretion. If you cancel or terminate your Service account for any reason, all email associated with that account (and any secondary accounts) will be permanently deleted as well.

If Paulding Putnam believes, in its sole discretion, that any subscriber name, account name or email address (each an “Identifier”) on the Service may be used for, or is being used for, any misleading, fraudulent or other improper or illegal purpose, Paulding Putnam: (i) reserves the right to block access to and prevent the use of any such Identifier, and (ii) may at any time require any customer to change his or her Identifier. In addition, Paulding Putnam may at any time reserve any Identifiers on the Service for its own purposes.

What requirements apply to instant, video and audio messages?
Each user is responsible for the contents of his or her instant, video and audio messages and the consequences of any of these messages. Paulding Putnam assumes no responsibility for the timeliness, mis-delivery, deletion or failure to store these messages. If you cancel or terminate your Service account for any reason, all instant, video and audio messages associated with that account (and any secondary accounts) will be permanently deleted as well.

III.     Network Management

Why does Paulding Putnam manage its network?
Paulding Putnam manages its network to deliver the best possible broadband internet experience to all of its customers. High-speed bandwidth and network resources are not unlimited. Managing the network is essential as Paulding Putnam works to promote the use and enjoyment of the internet by all of its customers. Paulding Putnam uses reasonable network management practices that are consistent with industry standards and tries to use tools and technologies that are minimally intrusive and, in its independent judgment guided by industry experience, among the best in class. Paulding Putnam expects that its network management practices will evolve along with the uses of the internet and the challenges and threats on the internet. By engaging in responsible network management, including enforcement of this Policy, Paulding Putnam can deliver the best possible broadband internet experience to all of its customers.

How does Paulding Putnam manage its network?
Paulding Putnam uses various tools and techniques to manage its network, deliver the Service and ensure compliance with this Policy and Subscriber Agreements. These tools and techniques are dynamic, like the network and its usage, and can and do change frequently. For example, these network management activities may include: (i) identifying spam and preventing its delivery to customer email accounts, (ii) detecting malicious internet traffic and preventing the distribution of viruses or other harmful code or content, (iii) temporarily lowering the priority of traffic for users who are the top contributors to current network congestion, and (iv) using other tools and techniques that Paulding Putnam may be required to implement in order to meet its goal of delivering the best possible broadband internet experience to all of its customers.

  1. Copyright

How does Paulding Putnam communicate with customers about copyright?
Paulding Putnam is committed to complying with U.S. copyright and related laws and requires all customers and users of the Service to comply with these laws. Accordingly, you may not store any material or content on, or access, share or disseminate any material or content over, the Service (or any part of the Service) in any manner that constitutes an infringement of third-party intellectual property rights, including rights granted by U.S. copyright law. Paulding Putnam complies with the Digital Millennium Copyright Act (“DMCA”) and provides a method for copyright owners to communicate information about alleged infringements to us and for us to inform our customers about them. You may receive notices or alerts if your Service account is identified by a copyright owner as having been used in connection with acts of alleged copyright infringement.

 

What is Paulding Putnam’s DMCA policy?
Owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed may take advantage of certain provisions of the DMCA to report alleged infringements. It is Paulding Putnam’s policy in accordance with the DMCA and other applicable laws to reserve the right to terminate the Service provided to any customer or user who is either found to infringe third-party copyright or other intellectual property rights, including repeat infringers, or who Paulding Putnam, in its sole discretion, believes is infringing these rights. Paulding Putnam may terminate the Service at any time with or without notice for any affected customer or user.

How do copyright owners report alleged infringements to Paulding Putnam under the DMCA?Copyright owners may report alleged infringements of their works by sending Paulding Putnam’s authorized agent a notification of claimed infringement that satisfies the requirements of the DMCA. Upon Paulding Putnam’s receipt of a satisfactory notice of claimed infringement for these works, Paulding Putnam will respond expeditiously to either directly or indirectly: (i) remove the allegedly infringing work(s), if applicable, or (ii) disable access to the work(s). Paulding Putnam will also promptly notify the affected customer or user of the Service of the removal or disabling of access to the work(s).

Copyright owners may send Paulding Putnam a notification of claimed infringement to report alleged infringements of their works under the DMCA to:

Copyright owners may use their own notification of claimed infringement form that satisfies the requirements of Section 512(c)(3) of the U.S. Copyright Act. Under the DMCA, anyone who knowingly makes misrepresentations regarding alleged copyright infringement may be liable to Paulding Putnam, the alleged infringer and the affected copyright owner for any damages incurred in connection with the removal, blocking or replacement of allegedly infringing material.

What can customers do if they receive a DMCA notification of alleged infringement?
If you receive a DMCA notification of alleged infringement as described above and you believe in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then you may send a counter notification to Paulding Putnam. Upon Paulding Putnam’s receipt of a counter notification that satisfies the requirements of the DMCA, Paulding Putnam will provide a copy of the counter notification to the person who sent the original notification of claimed infringement and will follow the DMCA’s procedures with respect to a received counter notification, including, without limitation, reinstating the removed material and/or reestablishing access to the same within 10-14 business days after receipt of the counter notification, unless the person who sent the original notification seeks a court order against the customer. In all events, you expressly agree that Paulding Putnam will not be a party to any disputes or lawsuits regarding alleged copyright infringement.

If a notification of claimed infringement has been filed against you, you can file a counter notification with Paulding Putnam's designated agent using the contact information above. All counter notifications must satisfy the requirements of Section 512(g)(3) of the U.S. Copyright Act.

  1. Violation of Policy

What happens if you violate this Policy?
Paulding Putnam reserves the right to immediately suspend or terminate your Service account and terminate the Subscriber Agreement if you violate the terms of this Policy or the Subscriber Agreement or if anyone else you permit to access the Service violates this Policy.

How does Paulding Putnam enforce this Policy?
Paulding Putnam does not routinely monitor the activity of individual Service accounts for violations of this Policy, except for determining aggregate data consumption. However, Paulding Putnam will respond appropriately if it becomes aware of inappropriate use of the Service. Paulding Putnam has no obligation to monitor the Service and/or the network. Paulding Putnam and its suppliers reserve the right at any time to monitor bandwidth, usage, transmissions and content in order to, among other things, operate the Service, identify violations of this Policy and/or protect the network, the Service and Paulding Putnam users.

Paulding Putnam prefers to inform customers of inappropriate activities and give them a reasonable period of time in which to take corrective action. Paulding Putnam also prefers to have customers directly resolve any disputes or disagreements they may have with others, whether customers or not, without Paulding Putnam’s intervention. However, if the Service is used in a way that Paulding Putnam or its suppliers, in their sole discretion, believe violates this Policy, Paulding Putnam or its suppliers may take any responsive actions they deem appropriate under the circumstances with or without notice. These actions include, but are not limited to, temporary or permanent removal of content, filtering of internet transmissions and the immediate suspension or termination of all or any portion of the Service. Neither Paulding Putnam nor its affiliates, suppliers or agents will have any liability for any of these responsive actions. These actions are not Paulding Putnam’s exclusive remedies, and Paulding Putnam may take any other legal or technical actions it deems appropriate with or without notice.

Paulding Putnam reserves the right to investigate suspected violations of this Policy, including the gathering of information from the user or users involved and the complaining party, if any, and examination of material and data on Paulding Putnam’s servers and network. During an investigation, Paulding Putnam may suspend the account or accounts involved and/or remove or block material that potentially violates this Policy. You expressly authorize and consent to Paulding Putnam and its suppliers cooperating with: (i) law enforcement authorities in the investigation of suspected legal violations, and (ii) system administrators at other internet service providers or other network or computing facilities in order to enforce this Policy. Upon termination of your Service account, Paulding Putnam is authorized to delete any files, programs, data, email and other messages associated with your account (and any secondary accounts).

Broadband and VOIP Service Privacy Policy

Effective Date of Policy: 18th Day of September, 2025.

The purpose of this policy statement is to explain how we treat your Personally Identifiable Information (PII”) collected by us relating to your subscription to a broadband service. PII is any information that identifies you individually. Aggregate non-individual information about a group of subscribers, which may include you, is not considered PII

  1. Information Collected About You. In the course of providing you our services, we may collect certain information that identifies you personally from all other subscribers. This information may include any of the following: your name, service address, billing address, telephone numbers, social security number, driver's license number, e-mail address, and credit information. We also maintain consumer service records about you relating to the following: billing and payment records, equipment usage, credit history, violations of your agreement with us, your service packages, the types and location of equipment installed by us in your home, equipment service calls and repairs, and whether you rent or own your home, if required to provision service. We may also collect information about your equipment to aid in providing consumer service support. From time-to-time, we may also collect consumer satisfaction surveys, interviews, and questionnaires from you. We may also keep records of all calls, e-mails, and correspondence received from you and sent to you by us.
  1. Why We Collect Your Personal Information. We collect the PII described above to help provide you with the best and highest quality service possible. We also collect this information for related business purposes and as may be required by our contractual and legal obligations.
  1. How We Use Your Personal Information. We utilize your PII for the following purposes: installation of equipment, repair and maintenance activities, billing of services, quality of service improvement, consumer service, advertising and marketing, verifying compliance with all applicable laws, verifying compliance with contractual obligations, tax and accounting purposes, and creating and marketing better service packages to you.
  1. How We Protect Your Personal Information. We will take reasonable technical and organizational precautions to protect against the loss, misuse or alteration or personal information. Such precautions may include:
  • Firewalls
  • Secure servers
  • Password protected computer stations
  • Encryption technology
  • Restricted access to facilities and/or storage units
  • Establishment of policies for the prevention and mitigation of identity theft

Such precautions do not guarantee that personal information cannot be accessed, altered or deleted due to physical, electronic or procedural failures, but are intended to be our reasonable precautions to protect your personal information.

  1. Parties Who May Receive Your Personal Information. The following parties may receive or have access to PII about you: our employees, agents and contractors, accountants, billing and collection services, credit reporting agencies, and authorized governmental bodies. Unless you object by contacting us, we may also disclose PII to some of our vendors. These vendors are obligated to treat your personal information as confidential and may not disclose it to any third parties without your consent. It is also important for you to understand that we do not sell or give access to your personal information to any third party for telemarketing, direct mail or solicitation.
     
  2. Disclosure Required by Law. As part of civil litigation or a regulatory proceeding, if we are required by a valid court or agency order, we may provide personal information about you to a party requesting such information provided that you are notified of such order by the party to whom the order is directed. We may also disclose your personal information to a governmental entity pursuant to a valid court order, if such entity offers clear and convincing evidence that you are reasonably suspected of engaging in criminal activity and that the information sought would be material to their case, and you are afforded an opportunity to appear and contest such entity's claim. We may also have to disclose the name and addresses of individuals as they appear in our subscriber records with respect to those who owe, or are owed, welfare support as part of an administrative subpoena from a state welfare agency. No court order or notice to you is required for such disclosure.
  1. Retention of Your Personal Information. We may retain your personal information as long as you are our consumer or until it is no longer needed for business or legal purposes, most notably for tax and accounting purposes. When your information is no longer needed for such purposes, we may destroy the information unless there is an outstanding request pursuant to a court order.
  1. Access to Your Personal Information. You have the right to inspect any of our records that contain your personal information for the purpose of correcting such records. If you wish to inspect your records, please notify us in writing and we will arrange such access, during normal business hours, at our office.

DCMA Copyright Infringement Policy

Effective Date of Policy: 18th Day of September, 2025.

The Digital Millennium Copyright Act (“DMCA”) provides a process for a copyright owner to give notification to a service provider, such as Paulding Putnam Electric Cooperative, Inc. (“Paulding Putnam”), of claimed copyright infringement. In compliance with the DMCA, Paulding Putnam will respond to proper notifications of claimed infringement and terminate, in appropriate circumstances, the accounts of subscribers who are repeat infringers.

Paulding Putnam is committed to complying with U.S. copyright and related laws and requires all customers and users of the Service to comply with these laws. Accordingly, you may not store any material or content on, or access, share or disseminate any material or content over, the Service (or any part of the Service) in any manner that constitutes an infringement of third-party intellectual property rights, including rights granted by U.S. copyright law. Paulding Putnam complies with the DMCA and provides a method for copyright owners to communicate information about alleged infringements to us and for us to inform our customers about them. You may receive notices or alerts if your Service account is identified by a copyright owner as having been used in connection with acts of alleged copyright infringement.

What is Paulding Putnam’s DMCA policy?

Owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed may take advantage of certain provisions of the DMCA to report alleged infringements. It is Paulding Putnam’s policy in accordance with the DMCA and other applicable laws to reserve the right to terminate the Service provided to any customer or user who is either found to infringe third-party copyright or other intellectual property rights, including repeat infringers, or who Paulding Putnam, in its sole discretion, believes is infringing these rights. Paulding Putnam may terminate the Service at any time with or without notice for any affected customer or user.

How do copyright owners report alleged infringements to Paulding Putnam under the DMCA?

Copyright owners may report alleged infringements of their works by sending Paulding Putnam’s authorized agent a notification of claimed infringement that satisfies the requirements of the DMCA. Upon Paulding Putnam’s receipt of a satisfactory notice of claimed infringement for these works, Paulding Putnam will respond expeditiously to either directly or indirectly: (i) remove the allegedly infringing work(s), if applicable, or (ii) disable access to the work(s). Paulding Putnam will also promptly notify the affected customer or user of the Service of the removal or disabling of access to the work(s).

Copyright owners may send Paulding Putnam a notification of claimed infringement to report alleged infringements of their works under the DMCA to:

Copyright owners may use their own notification of claimed infringement form that satisfies the requirements of Section 512(c)(3) of the U.S. Copyright Act. Under the DMCA, anyone who knowingly makes misrepresentations regarding alleged copyright infringement may be liable to Paulding Putnam, the alleged infringer and the affected copyright owner for any damages incurred in connection with the removal, blocking or replacement of allegedly infringing material.

What can customers do if they receive a DMCA notification of alleged infringement?

If you receive a DMCA notification of alleged infringement as described above and you believe in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then you may send a counter notification to Paulding Putnam. Upon Paulding Putnam’s receipt of a counter notification that satisfies the requirements of the DMCA, Paulding Putnam will provide a copy of the counter notification to the person who sent the original notification of claimed infringement and will follow the DMCA’s procedures with respect to a received counter notification, including, without limitation, reinstating the removed material and/or reestablishing access to the same within 10-14 business days after receipt of the counter notification, unless the person who sent the original notification seeks a court order against the customer. In all events, you expressly agree that Paulding Putnam will not be a party to any disputes or lawsuits regarding alleged copyright infringement.

If a notification of claimed infringement has been filed against you, you can file a counter notification with Paulding Putnam's designated agent using the contact information above. All counter notifications must satisfy the requirements of Section 512(g)(3) of the U.S. Copyright Act.

  1. Notice of Claimed Copyright Infringement:

Pursuant to the DMCA, copyright owners may submit to the designated agent of a service provider a notice of claimed copyright infringement carried out on the service provider’s network or on the service provider’s system.

When Paulding Putnam receives a proper notification of claimed copyright infringement from a copyright owner or its authorized agent under the DMCA, it will take the following steps:             

  1. First warning – Paulding Putnam will send a letter to the subscriber describing the claimed copyright infringement and stating that the infringement constitutes a violation of Paulding Putnam’s Acceptable Use Policy (“AUP”) and terms and conditions of service. The letter will also inform the subscriber that Paulding Putnam may suspend or terminate service if violation continues.
  2. Second warning – If there is a second offense within a 12-month period, Paulding Putnam will send a second warning letter. This letter will notify the subscriber of the claimed copyright infringement and violation of the AUP and terms and conditions of service. The letter will also inform the subscriber that Paulding Putnam may suspend or terminate service if violation continues.
  3. Final warning – If there is a third offense in a 12-month period, Paulding Putnam will issue a final warning letter to the subscriber. This letter will be sent via certified mail. This letter will notify the subscriber of the claimed copyright infringement and violation of the AUP and terms and conditions of service. The letter will also inform the subscriber that Paulding Putnam may suspend or terminate service if violation continues.
  4. Notice of termination – If there is a fourth offense in a 12-month period, Paulding Putnam will terminate the subscriber’s service and send a letter to the subscriber via certified mail. This letter will notify the subscriber that its account has been terminated effective immediately and that all equipment should be returned to Paulding Putnam.

Paulding Putnam reserves the right to act immediately and without notice to suspend or terminate services in response to a court order or other legal requirement that certain conduct be stopped or when Paulding Putnam determines that the allegedly infringing conduct may:

  • Expose Paulding Putnam to sanctions, prosecution or civil action;
  • Cause harm to or interfere with the integrity or normal operations of Paulding Putnam’s network or facilities;
  • Interfere with another person’s use of Paulding Putnam services or the internet;
  • Damage or disparage the reputation of Paulding Putnam or its services; or
  • Otherwise present a risk of harm to Paulding Putnam or its subscribers, employees, officers, directors, agents or other representatives.

If Paulding Putnam’s designated agent receives an effective counter notification from a subscriber under the DMCA, Paulding Putnam will replace any removed material and/or restore access to the subscriber’s service, if the subscriber’s account has been terminated, between 10 and 14 business days following receipt of the counter notification, unless as otherwise provided by law.

  1. Record Retention:

All copyright infringement notifications received, related supporting documentation and related correspondence with the subscriber shall be retained by Paulding Putnam for at least five years. 

A database that includes account numbers, dates of notification and other pertinent information related to copyright infringement notices and correspondence will also be maintained by Paulding Putnam.

III.      Designated Agent:

The Chief Operating Office shall be Paulding Putnam’s designated agent to receive all copyright infringement and DMCA notifications. This position, with the help of IT and customer support, is responsible for carrying out the steps of this policy.

E911 Disclosure for Paulding Putnam Electric Cooperative, Inc.

Interconnected VoIP Customers

Pursuant to Section 9.11(b)(5) of the Federal Communications Commission’s (“FCC”) rules,[1] all interconnected VoIP service providers, including Paulding Putnam Electric Cooperative, Inc. (“Paulding Putnam”), are required to “specifically advise every subscriber, both new and existing, prominently and in plain language, the circumstances under which E911 service may not be available through the interconnected VoIP service or may be in some way limited by comparison to traditional E911 service.” 

911-type services provide functionality that allows end users to contact emergency services, including, without limitation, police, fire and medical emergency services. 911-types services may include enhanced 911-type service (“E911”), which has the ability to selectively route an emergency call to the primary 911 provider so that it reaches the correct emergency service located closest to the subscriber location and to transmit the identification of the subscriber location and telephone number (subject to the obligations to provide and maintain the subscriber location information).

Paulding Putnam asks that you carefully read this E911 Disclosure and understand how your use of interconnected VoIP service may affect your ability to access E911 services. If you have any questions or concerns about the information contained in this notice, or if you do not understand anything discussed in this notice, please contact Paulding Putnam at 1-800-686-2357 during the hours of 7:30am – 4:00pm EST.

 

E911 Policy

  1. PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICES MAY NOT OPERATE DURING A POWER OUTAGE. A power outage causing a loss of voice and data service may also cause loss of access to E911 services. Once power service is restored, you may be required to reset or reconfigure your equipment before you will be able to use Paulding Putnam interconnected VoIP service to access E911 services. 
  1. PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICES WILL NOT OPERATE IF YOUR BROADBAND CONNECTION IS DISRUPTED OR PAULDING PUTNAM BROADBAND OR INTERCONNECTED VOIP SERVICE HAS BEEN SUSPENDED FOR ANY REASON, INCLUDING, WITHOUT LIMITATION, NON-PAYMENT. Once your broadband connection and interconnected VoIP service have been restored, you may be required to reset or reconfigure your equipment before you will be able to use Paulding Putnam interconnected VoIP service to access E911 services.
  1. YOU MUST PROVIDE PAULDING PUTNAM WITH YOUR CORRECT SERVICE ADDRESS OR PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICE CALLS MAY BE ROUTED TO EMERGENCY PERSONNEL WHO WILL NOT BE ABLE TO ASSIST YOU. If you notice that the service address information identified in your contract or bill is inaccurate, you can make corrections by calling Paulding Putnam at 1-800-686-2357 during the hours of 7:30am – 4:00pm  EST.
  1. PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICE CALLS MAY NOT COMPLETE OR MAY BE ROUTED TO EMERGENCY PERSONNEL WHO WILL NOT BE ABLE TO ASSIST YOU IF YOU DISABLE, DAMAGE OR MOVE TO A LOCATION OTHER THAN THE SERVICE ADDRESS YOU PROVIDED TO PAULDING PUTNAM WHEN SERVICE WAS INITIATED. If you wish to move to a new service address, please call Paulding Putnam at 1-800-686-2357 during the hours of 7:30am – 4:00pm EST.
  1. PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICE CALLS MAY BE DELAYED OR DROPPED DUE TO NETWORK ARCHITECTURE. Due to network congestion or problems, calls to E911 services made using Paulding Putnam interconnected VoIP service may be dropped, in which case you will not be connected to emergency services or your E911 calls may take longer to connect than E911 calls made using traditional telephone service.
  1. PAULDING PUTNAM INTERCONNECTED VOIP E911 SERVICES ARE NOT AVAILABLE WHEN USING A SOFTPHONE ON MOBILE OR DESKTOP APPLICATIONS.

IN ADDITION, YOU SHOULD MAINTAIN ALTERNATE MEANS OF ACCESSING E911 SERVICES, AND YOU MUST INFORM ALL USERS OF YOUR PAULDING PUTNAM INTERCONNECTED VOIP SERVICE OF THESE ALTERNATE MEANS. Please contact Paulding Putnam at 1-800-686-2357 during the hours of 7:30am – 4:00pm EST for additional information.

Disclaimer of Liability for Emergency Call Response

Your use, and use by your employees, guests and other third parties, of Paulding Putnam’s E911 services are subject to the limitations described herein. The availability of certain features, such as transmission of a Registered Address or your Paulding Putnam telephone number, depends on whether local emergency response centers support those features and other factors outside of Paulding Putnam’s control. Paulding Putnam relies on qualified third parties to assist it in routing 911 calls to local emergency response centers. Paulding Putnam does not have control over local emergency response centers, emergency responders or other third parties. Paulding Putnam disclaims all responsibility for the conduct of local emergency response centers, third parties engaged by you to facilitate address updates, and all other third parties involved in the provision of emergency response services. To the extent permitted by applicable law, you hereby release, discharge and hold harmless Paulding Putnam from and against any and all liability relating to or arising from any acts or omissions of such third parties or other third parties involved in the handling of or response to any emergency or 911 call.

You indemnify and hold harmless Paulding Putnam and any third-party provider(s) from any and all third-party claims, losses, damages, fines or penalties arising out of: (i) your or your end user’s provision to Paulding Putnam of incorrect information, including physical addresses, or failure to update a Registered Address; (ii) your failure to properly provide notification of the 911 limitations to any person who may place calls using the services; (iii) the absence, failure or outage of emergency service dialing using the services for any reason; or (iv) the inability of any end user to be able to dial 911 or access emergency service personnel for any reason.
